This privacy notice explains how we use any personal information we collect about you.

 

In providing the services to clients, our companies will act as a data controller of any personal data which we collect from or about our clients in connection with the provision of our services.

 

For the purposes of this notice, the Data Controller is defined as a person that determines the purposes for which, and the manner for which, any personal data is processed, in line with article 4(7) of the General Data Protection Regulation ((EU) 2016/679).

 

Where other companies and/or third parties provide support services, such as I.T. development and maintenance, there may be occasions where data is accessible to such parties. Our companies have the appropriate safeguards and agreements in place with each service provider to ensure data is protected and meets General Data Protection Regulation requirements.

 

What information do we collect about you?

 

We collect information about you when you engage us for financial planning, investment management and employee services.

 

This information will relate to your personal and financial circumstances.

 

The information could include:

 

Individual details: Name, address (including proof of address), other contact details (e.g. email and telephone numbers), gender, marital status, date and place of birth, nationality, employer, job title and employment history, and family details, including their relationship to you.

 

Identification details: Identification numbers issued by government bodies or agencies, including your national insurance number, passport number, tax identification number and driving licence number.

 

Financial information: Bank account, income or other financial information.

 

Risk details: Information about you and other connected individuals which we need to collect in order to assess the services required. This may include data relating to health or other special categories of personal data (see below).

 

Policy information: Information about the financial products you hold and the insurance policies you take out.

 

Credit and anti-fraud data: We’ll verify your identity before providing any services through the use of an electronic identity verification system called Smart Search. We will also conduct these checks from time to time throughout our relationship, not just at the beginning. The check may leave a ‘footprint’ on your credit file but it won’t affect your credit rating.

 

In certain circumstances if it is necessary for the provision of our services, we collect special categories of data which could include health, criminal convictions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric, or data concerning sex life or sexual orientation.

 

We will collect personal information about you from you directly but also potentially from your family members, employer or representative, other market participants, credit reference agencies, anti-fraud databases, sanctions lists, court judgements and other judicial databases, government agencies such as the HMRC, open electoral register and any other publicly available data sources.

 

We may also collect information when you voluntarily complete client surveys or provide feedback to us.

 

Information about connected individuals

 

We may need to also gather personal information about your close family members and dependants in order to provide our service to you effectively. In such cases it will be your responsibility to ensure that you have the consent of the people concerned to pass their information on to us. We will provide a copy of this privacy notice for them or, where appropriate, ask you to pass the privacy information to them.

Who might we share your information with?

 

If you have agreed to and signed our declaration showing you have agreed, we’ll pass on your personal information to our group of companies so that they may offer you their products and services.

In order to deliver our services to you effectively we may send your details to third parties such as those that we engage for professional compliance, accountancy, or legal services as well as product and platform providers that we use to arrange financial products for you.

 

Where third parties are involved in processing your data, we will have a contract in place with them to ensure that the nature and purpose of the processing is clear, that they are subject to a duty of confidence in processing your data and that they’ll only act in accordance with our written instructions.

 

Where it’s necessary for your personal data to be forwarded to a third party we’ll use appropriate security measures to protect your personal data in transit.

 

Where we are required to transfer Special Categories of Data for example health information, we will transfer this information via secure postal services or through the use of encryption software to ensure the safe and secure receipt by the intended product provider.

 

To fulfil our obligations in respect of prevention of money-laundering and other financial crime, we may send your details to third party agencies for identity verification purposes.

 

How long do we keep hold of your information?

 

During the course of our relationship with you, we will retain personal data which is necessary to provide services to you. We’ll take all reasonable steps to keep your personal data up to date throughout our relationship, and whenever you inform us about any changes we will update this information at the earliest opportunity.

 

Please help us to do this by letting us know whenever there are changes to your personal data. If you are providing information about someone else, you confirm that they have appointed you to act for them, to consent to the processing of their personal data, including special categories of personal data, and that you have informed them of our identity and the purposes (as set out in this Privacy Notice) for which their personal data will be processed.

 

We are also subject to regulatory requirements to retain your data for specified minimum periods. These are, generally:

 

  • Five years for investment business
  • Indefinitely for pension transfers and opt-out business
  • Three years for insurance business

 

These are minimum periods, during which we have a legal obligation to retain your records.

 

We reserve the right to retain data for longer where we believe it’s in our legitimate interests to do so.

 

You have the right to request deletion of your personal data. We will comply with this request, subject to the restrictions of our regulatory obligations and legitimate interests as noted above.
